Your Class Action Lawyers
New York City Class Action Attorneys
The class action lawyers at German Rubenstein LLP have been appointed by state and federal judges to leadership roles in class actions across the United States. Class action lawsuits serve the public interest by holding corporations, municipalities, and other wrongdoers accountable for their conduct. Our class action lawyers have the dedication and experience to handle these complex cases.
A class action lawsuit is decided by one judge in one court. Thus, the litigation will take up less cumulative court time and involve fewer judges.
Common Types of Class Action Lawsuits Include:
- Environmental Pollution
- Insurance Fraud
- Consumer Fraud
- Civil Rights
- Wage and Hour
- Discrimination
- Antitrust
- Securities and Financial Services
- Privacy and Technology
How We Handle Class Actions
Class action lawsuits require court approval. There is a rigorous process to certifying – or obtaining court approval of – a class action, which makes hiring the right class action law firm essential. German Rubenstein Class Action lawyers have the experience and will:
- Investigate your claim to determine if there is liability.
- File the Lawsuit: Typically, a class-action lawsuit is started by filing a Complaint that names at least one class representative, and that representative files the lawsuit on behalf of the entire proposed class. The defendant(s) will have a right to respond to the lawsuit in an Answer.
- Obtain Class Certification: Once the complaint is filed, the lawyers for the class representative will file a motion asking the court to certify or approve the proposed class. To get approval of the class, the class representative and the law firm representing the class representative must demonstrate, through a class certification process, that the requirements of class certification are met.
- Assign a lead plaintiff: The plaintiff who files the lawsuit, normally the class representative, needs to be formally approved as the lead plaintiff when the class is certified.
- Provide notice to members of the class: In most cases, once the lawsuit is certified as a class action, notice, through direct mail, news media, and/or on-line, must be sent to all individuals who could be considered part of the class. The notice explains the rights of the class members.
- Try the case or negotiate a settlement: Once the class is certified and notice provided, the case may proceed through additional merits discovery and then to a decision by a judge or jury – unless a settlement is reached. If a verdict or a settlement is reached, all class members must be notified of their rights and responsibilities, including their right to opt out of the settlement or object to it.
Common Questions About Class Action Lawsuits
What is a Class Action?
A class action is a procedural device that permits one or more plaintiffs to file and prosecute a lawsuit on behalf of a larger group or “class.” The class action procedure allows courts to manage lawsuits that would otherwise be unmanageable if each class member (individuals who have suffered the same wrong at the hands of the defendant) were required to be joined in the lawsuit as a named plaintiff.
What are the Benefits of a Class Action?
Joining claims into a single case – a class action – is often more efficient and economical for the plaintiffs, the court, and the defendants. For example, class actions mean just one set of witnesses, one set of experts, one set of documents, and one set of issues, for all the injured parties. Often, individual cases do not have enough damages to justify the time and expense to bring cases separately for each injured party, and the efficiency of class actions makes bringing these claims possible.
How Much is My Case Worth?
Compensation largely depends on the nature and severity of the victim’s injuries and damages. Our nationwide class action attorneys represent victims, demanding compensation for:
- Civil Rights violations
- Environmental cleanup costs
- Loss of property value
- Financial losses from fraud and deceptive business practices
- Financial damages from insurance fraud
- Loss of use and enjoyment of property
- Pain and suffering
- Medical expenses
- Lost wages
- Loss of future earning capacity
- Emotional anguish
- Punitive damages
How Long Do I Have To Bring a Lawsuit?
The Statute of Limitations is the legal time frame within which you must file a lawsuit related to a specific event. If you wait too long to contact a lawyer, you may lose your right to sue due to the statute of limitations expiring. If you think you might have a legal claim, it is crucial to speak with a lawyer as soon as possible to assess your situation and determine the best course of action.
